The second issue of the Article 40 publication of 2012 has been published. It features the following three articles:
- An article by Dr Leon Holtzhausen providing a review of the theoretical foundations for the assessment of the criminal capacity of children between the ages of 10 and 14 years. Dr Holzthausen does so by using the case study of a 13-year-old boy who was charged with taking part in the gang-rape of a mentally disabled girl in Soweto.
- Tegan Clark provides an analysis of the “Guidelines on Action for Children in the Justice System in Africa” which have been developed to guide African State Parties in law reform and harmonisation of their child justice laws to ensure compliance with international human rights treaties.
- Lorenzo Wakefield provides an overview of the proceedings of the UN Human Rights Council’s nineteenth ordinary session which focussed on children and the administration of justice.
