The Traditional Courts Bill, which was published in 2008 and subject to numerous submissions, will be introduced into the National Council of Provinces in January 2012.
The purpose of introducing it into the NCOP is to address the numerous concerns raised in the submissions previously made.
Further comments on the Bill are invited and should be submitted by 15 February 2011 to the Secretary of Parliament, P O Box 15, Cape Town.
The Bill aims to affirm the recognition of the traditional justice system and its values, based on restorative justice and reconciliation; to provide for the structure and funding of traditional courts in line with constitutional imperatives and values; to enhance customary law and the customs of communities observing a system of customary law.
