Limpopo Education department in breach of right to education

Section 27, a social justice NGO, successfully sued the Limpopo Department of Basic Education for failing to deliver text books in time for the start of the school year to a number of schools.

Judge Kollapen found that the failure to deliver textbooks to learners throughout Limpopo was a violation of children’s right to basic education. He ordered that the books be delivered to all schools by 15 June 2012, and that a catch-up plan be formulated in terms of which gaps in the curricula are identified and the extent to which children have fallen behind as a result of the delayed delivery. The plan must indicate what measures are being put in place to ensure that children catch up. The Department must lodge monthly reports with the court indicating progress in catching up.
